I think the distinction you make ...Wonderful essay! I think the distinction you make between justice and equity is very important and not widely enough appreciated. Very often people find the criminal justice system not fair. As has been pointed our here before justice is about winning and, in the adversarial system we wind up with a winner and loser but with equity we are able if the negotiations are effective in a win-win situation. People seem bewildered and confused when court decisions are not fair, but the process isn't set up to do arrive at fairness and so people are mislead to expect something that the system never intends no is rarely equipped to deliver.Aaron Davidsonnoreply@blogger.com
